Roger Eaton is a New Mexico and Colorado Injury/Trial Lawyer with more than 38 years experience.

Roger Eaton has tried more than 30 jury trials and more than 100 non-jury matters to a Court or an Administrative Law Judge. Roger been involved in more than 17 appeals, some of which have established controlling New Mexico law including:

Beavers v. Johnson Controls World Services, 120 N.M. 343, 901 P.2d 761 (N.M. App. 1995). This case established the first recovery in the State of New Mexico for a prima facie tort.

Stinbrink v. Farmers Insurance, 111 N.M. 179, 803 P.2d. 664 (N.M. 1989. This case established an insured's right to recover punitive damages from his uninsured/underinsured insurance policy.

Levy v. Disharoon, 106 N.M. 699, 749 P.2d 84(1988). The case permitted a partner to recover punitive damages and attorney’s fees from another partner for a breach of fiduciary duty.

U.S. v. McCall, 235 F.3d 1211(10th Cir. 2000). This case upheld a lower court ruling that prevented the United States from foreclosing on an obligation and provided for the recovery of attorney’s fees on the government's failure to perform a contract to which it had agreed.

Encinias v. Whitener, 2013-NMSC-045 (2013). This case determined that a school could be liable for student-on-student violence that occurred in an area which was a known area of violence that was not properly patrolled. This ruling came out of a case in which a law firm failed to file a suit against the school district within the Statute of Limitations.
